However, the said fact was neither within the knowledge of the undersigned counsel at the time of filing the petition nor was it disclosed or brought to the notice of the undersigned by the petitioners. In view of the filing of the charge sheet, the present Criminal Petition challenging only the FIR and complaint has become infructuous. Therefore, the undersigned respectfully prays that this Hon'ble Court may be pleased to permit the petitioners to withdraw Criminal Petition No. 8429/2026 with liberty to file a fresh petition challenging the charge sheet and seeking such other appropriate reliefs as may be available under law.
