1. Following reliefs have been prayed in this petition:-
“10.1. This Hon'ble Court may Graciously be pleased to Issue Appropriate Writ Commanding Respondent Authorities for Handing Over the Possession of the Secured Asset in Favor of the Present Petitioner as Adjudicated by the CJM Raipur Order Dated 17.11.2025 Passed in M.J.C No.1631/2025 AU Small Finance Bank V/s M/s Amit Transcontinental and 1 Anr. Immediately and Scrupulously. 10.2. Any other relief, which this Hon'ble Court may deem fit and Proper for the Just Adjudication of the case and protecting Constitutional Rights of the Petitioner. 10.3 Cost of the petition.”

Learned counsel for the petitioner submits that, in view of the pendency of the securitisation application preferred by the petitioner before the competent Debts Recovery Tribunal, the present writ petition may be disposed of with liberty to the petitioner to take all necessary and appropriate steps against the
3 borrower, in accordance with law, after disposal of the said securitisation application. 3. Learned counsel appearing for the respondents does not oppose the aforesaid submission. 4.
Accordingly, the present writ petition is disposed of with liberty to the petitioner to take such appropriate steps against the borrower as may be available to it in law, after the securitisation application pending before the competent Debts Recovery Tribunal is decided. 5. It is made clear that this Court has not expressed any opinion on the merits of the claim of either party.
