Learned counsel for the petitioner submits that the petitioner is challenging the impugned transfer order dated 06.08.2026, JYOTI SHARMA Digitally signed by JYOTI SHARMA Date: 2026.08.18 10:36:06 +0530
2 whereby she has been transferred from Government Middle School, Jhagrakhand, District Manendragarh-Chirmiri-Bharatpur to a place to be determined at the choice of the District Education Officer, District Korea. It is submitted that the petitioner has been serving as a Teacher since 1998 and the impugned transfer is contrary to the applicable Transfer Policy and has been issued during the ban period. Learned counsel further submits that the petitioner is the sole caregiver of her 82-year-old mother, who is suffering from serious ailments requiring continuous medical supervision. It is submitted that in view of the aforesaid circumstances, the impugned transfer is arbitrary and liable to be interfered with.
2. Per contra, learned State counsel opposes the petition and submits that, in case the petitioner submits a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy, the same shall be considered and decided in accordance with law.
3. I have heard learned counsel for the parties and perused the record.
4. Considering the nature of the grievance raised by the petitioner and the submission made by learned State counsel, without expressing any opinion on the merits of the case, the petitioner is
directed to submit a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy within a period of 10 days from today. In case such representation
3 is submitted within the aforesaid period, the competent Transfer Committee shall consider and decide the same by passing a reasoned and speaking order, strictly in accordance with law and the applicable Transfer Policy, preferably within a period of 25 days thereafter.
5. With the aforesaid observations, the present writ petition stands
