JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned Additional Government Advocate accepts notice for the respondents. 2. Petitioner is before this Court seeking for the following reliefs: a. Issue writ of Certiorari by quashing the impugned endorsements 15-08-2025, 21.03.2026 and 10.06.2026 issued B1 and 32 by the 4th respondent produced vide Annexure-B, as illegal and; b. Issue writ of mandamus directing the respondent No.4 to register the case by handing over the investigation to - 3 - HC-KAR CNR: KAHC010490432026 NC: 2026:KHC:39661 WP No. 22213 of 2026 CID/respondent No.3 for through investigation regarding trespass, theft and cheating by considering the complaints dated 25.02.2026 and 21.03.2026 produced vide Annexures- A and A1, in the interest of justice. c. Issue any other writ/s as this Hon'ble Court deems fit in the facts and circumstance of the case. 3. The allegations which have been made by the petitioner is as regards house trespass and removal of the items in the house of the petitioner by certain persons against whom a complaint had been filed, as regards which an endorsement has been issued stating that the matter is civil in nature. 4. When a trespass has been alleged which is a cognizable and non-bailable offence, it was required for the respondents to take necessary action by registering the FIR and investigating into the matter. 5. The further submission of Sri. M.T.Nanaiah, learned Senior Counsel for the petitioner is that the CCTV footage of the premises would have to be secured by the Investigating Officer for the purpose of proper investigation. 6. In that view of the matter, this Court passes the following: ORDER i) Writ petition is allowed. - 4 - HC-KAR CNR: KAHC010490432026 NC: 2026:KHC:39661 WP No. 22213 of 2026 ii) A Certiorari is issued, the endorsements dated 15.08.2025, 21.03.2026 and 10.06.2026 at Annexure-B, B1 and B2 passed by respondent No.4 is set aside. iii) Respondent No.4 is directed to register a FIR in terms of the complaint filed and cause investigation into the matter. iv) Respondent No.4 is also directed to secure the CCTV footage in respect to the subject property by issuing necessary direction as per the applicable law.
