THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: "a) Issue a writ, order , or direction in the nature of Mandamus, directing the Respondent No.3 forthwith register an FIR based on the petitioner's written complaint dated 29.06.2026 at Annexure-'A' regarding the incident dated 28.06.2026. b)Direct the Respondent No.2 (DCP) to monitor the investigation and ensure that a fair and impartial probe is conducted into the matter. c)Direct the concerned police to take necessary measures to protect the life and liberty of the petitioner. d) To allow the petitioner with cost and - 3 - HC-KAR CNR: KAHC010446132026 NC: 2026:KHC:42102 WP No. 19914 of 2026 e) Pass any other order(s) or directions(s) that this Hon'ble Court may deem fir and proper in the interest of justice." 2. The complaint has been lodged by the petitioner on 29.06.2026. No FIR was registered and investigation taken up. In that background, that the petitioner is before this Court seeking for the aforesaid reliefs. 3. A perusal of the complaint along with the MLC which has been registered which was enclosed along with the complaint would indicate grievous injuries which have been caused to the petitioner. When such complaint has been filed as regard to cognizable offence, it was required for the respondents to have immediately register the complaint and taken up the investigation, rather than delay the matter by over a month now. More so, when in such cases, evidence would have to be gathered immediately, lest they be lost due to passage of time. - 4 - HC-KAR CNR: KAHC010446132026 NC: 2026:KHC:42102 WP No. 19914 of 2026 4. In that view of the matter, this Court passes the following: ORDER i) Writ petition allowed. ii) Mandamus is issued directing respondent No.3 to forthwith register FIR based on the complaint dated 29.06.2026 at any rate by end of day 08.08.2027 and furnish a copy thereafter. The *respondent No.3 has also to carry out proper investigation and file the investigation report at the earliest.
