1. Learned State counsel submits that the petitioner has challenged the order passed by the Tehsildar, Navagarh, without availing the statutory alternative remedy of filing an appropriate appeal before the competent Sub-Divisional Officer (Revenue). It is, therefore, contended that the present petition is not maintainable.
2. Having considered the submissions made by learned State counsel and the fact that an efficacious alternative statutory remedy of appeal is available to the petitioner, which has not been availed, this Court is not inclined to entertain the present petition at this stage.
3. Accordingly, the writ petition is disposed of with liberty to the petitioner to avail the statutory alternative remedy available under law, if so advised.
