Ali Ahasan ….for the petitioners Mr. Mukherjee, learned advocate appearing for the petitioner submits that though the order being no.106 dated April 27, 2026 passed in Other Suit No.1 of 2013 is under challenge in this civil revisional application but he has instruction only to pray for a direction upon the learned trial judge to dispose of the Other Suit No.1 of 2013 expeditiously. From the order sheets appended to this application this Court finds that June 2, 2026 was fixed for evidence of P.W.3. Mr. Mukherjee submits that the next date for evidence of P.W.3 has been fixed on September 28, 2026. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2794 of 2026 stands disposed of by requesting the learned Additional District 2 Judge, 2nd Court at Suri, District-Birbhum to take up the evidence of P.W.3 on the next date fixed i.e. on September 28, 2026, and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
