JUSTICE P SREE SUDHA ORAL ORDER This petition is filed by the husband for transfer of Crl.Misc.No.211/2022 pending on the file of MMTC, Bengaluru and to transfer the same to III Addl. Prl.Judge Family Court, Bengaluru and to club the matter along with Crl.Misc.No.20/2023 and M.C.No.1011/2025 both pending before the III Addl. Prl.Judge Family Court, Bengaluru. 2. Heard the arguments of learned counsel for petitioner and respondent. 3. The transfer application is filed by husband for transfer of the said case to another III Additional Principal Judge Family Court at Bengaluru, on the ground that - 3 - HC-KAR CNR: KAHC010486912026 NC: 2026:KHC:43004 CP No. 232 of 2026 Crl.Misc.20/2023 filed by wife is also pending before the court and he filed MC No. 1011/2025 for divorce and it is also pending before the concerned court. 4. Office took an objection on the ground that it is a criminal proceedings and it cannot be transferred to the Civil Procedure pending before the Family Court. 5. Learned counsel for the petitioner relied upon a citation in Crl.P.No.8472/2019 between Mr.Samarth Vimal Jagnani and Ors Vs Mrs.Arzoo Samarth Jagnani dated 31.01.2023. in which the case filed under domestic violence was also transferred to the concerned court, in view of pendency of maintenance case and divorce case before the same court for the convenience of the parties. 6. In the domestic violence case, the wife claimed, protection under Sections 12, 18, 19, 20 and 22 of Protection of Women from Domestic Violence Act and also Rs.35,000/- towards maintenance. As she already filed - 4 - HC-KAR CNR: KAHC010486912026 NC: 2026:KHC:43004 CP No. 232 of 2026 another application for maintenance and it is pending before the III Additional Principal Judge Family Court, this Court finds that it is just and reasonable to transfer Crl.Misc.No.211/2022 pending on the file of MMTC, Bengaluru, also to the III Additional Principal Judge Family Court, Bengaluru, to try along with other cases.
