Accused no.5 in Crime No.136/2023 registered by Girinagar Police Station, Bengaluru City, for the offences punishable under Sections 307, 323, 341, 504 read with 34 IPC is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.136/2023 was registered by Girinagar Police Station, Bengaluru City, against Yogesh and another based on the first information dated 26.04.2023 received from Yuvaraj - nephew of the injured victim Venkatesh. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.6181/2026 which was rejected on 29.06.2026 by the jurisdictional Sessions Court. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that FIR in the present case is registered against two persons viz., Yogesh and Narasimha. The presence of other accused persons - 3 - HC-KAR CNR: KAHC010473562026 NC: 2026:KHC:43305 CRL.P No. 10231 of 2026 on the spot of crime was not mentioned in the FIR. After completing investigation, charge sheet was filed against five persons. The allegation of stabbing Venkatesh is as against accused no.1 in the charge sheet. The other accused persons allegedly had assaulted Venkatesh with their hands. 5. Learned Addl.SPP who has brought to the notice of this Court that petitioner was earlier involved in two other criminal cases, does not dispute that the allegations found in the said criminal cases are not grave in nature. 6. Considering the nature of allegations as against the petitioner in the present case and also the fact that his name is not found in the FIR, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.136/2023 registered by Girinagar Police Station, Bengaluru City, for the - 4 - HC-KAR CNR: KAHC010473562026 NC: 2026:KHC:43305 CRL.P No. 10231 of 2026 offences punishable under Sections 307, 323, 341, 504 read with 34 IPC, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
