Olidih, P.S. Olidih, Dist. East Sinbhghum (Jharkhand). ....Petitioner Versus The State of Jharkhand ....Opp. Party --------- CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN --------- For the Petitioner : Mr. A.K. Pandey, Advocate For the Opp. Party : Mr. Fahad Allam, A.P.P. (Through: V.C.) --------- 09/ 01.04.2026 Heard learned counsel for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail in connection with Olidih P.S. Case No. 129 of 2024 (Special POCSO Case No. 64 of 2024) for the offences registered under Sections 376(3) of IPC and Sections 4 and 6 of POCSO Act, pending in the court of learned Special Judge, POCSO Act, Jamshedpur. 3. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Learned counsel further submits that as per column-3 of the FIR, the occurrence took place on 01.11.2023 but the FIR was lodged on 03.05.2024 without explanation of delay by the informant. He further submits that the daughter of the informant has not been medically examined. Petitioner is having no criminal antecedent. He further submits that petitioner is languishing in custody since 03.05.2024; as such, the petitioner may be enlarged on bail. Learned counsel further submits that the petitioner is ready to abide by every condition imposed by this court. 4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that the allegation against the petitioner is serious in nature inasmuch as the petitioner has made physical relationship with minor victim on the pretext of marriage. 2026:JHHC:9160 2 5. Looking to the gravity of charge against the petitioner that he has made physical relationship with the minor victim on the pretext of marriage, which finds strength from the statement of the victim recorded u/s. 164 Cr.P.C., I am not inclined to enlarge him on bail at this stage. 6. However, since charges have been framed on 08.10.2024, therefore, the learned Trial Court is requested to expedite the matter and conclude the trial at the earliest. 7. Accordingly, the instant application stands dismissed. (Deepak Roshan, J.) 1st April, 2026 kunal/- Uploaded on 04.04.2026
