Heard Mr. Quazi, learned counsel for the petitioner.
2. At the outset, he submits that the order impugned is ex facie illegal and he can test it before the appellate authority under Section 257 of the Maharashtra Land Revenue Code, 1966. He further request that this Court vide its order dated 20.07.2024 has dealt with the matter and that may be a guiding factor for deciding the appeal.
3. Be that as it may, at this stage, we cannot comment anything on the merit of the case, but fact remains that the appellate authority will have to take into Prity

consideration the order passed on 20.07.2024 in Writ Petition No.3395/2018.
4. The learned counsel for petitioner then seeks permission to withdraw the present petition with liberty to file the appeal before the competent authority.
5. Since, prayer is innocuous, we permit the petitioner to withdraw the petition with liberty to file appropriate proceedings, challenging the order impugned in this petition.
6. It is made clear that if the appeal is filed within ten days from today, same shall be decided within a period of three months in accordance with law, since it is on the third occasion the petitioner has invoked the writ jurisdiction of this Court.
