Learned counsel for the petitioner submits that the petitioner has been transferred from Government High School, Namna, Block Udaipur, District Surguja (C.G.), to the O3ce of the District Education O3cer, Korba, and the name of the petitioner is re7ected at Serial No. 15 in the impugned transfer order.

Learned counsel further submits that the petitioner's husband, namely, Gajendra Pal, is also posted in the same school, i.e., Government High School, Namna, Udaipur, District Surguja. He further submits that the petitioner's 15- year-old daughter is su;ering from a serious diabetic condition and, on the advice of the doctors, is required to take insulin three times a day and is presently undergoing treatment in Bilaspur. However, the petitioner has been transferred to the O3ce of the District Education O3cer, Korba, which is situated at a distance of approximately 155
3 kilometres from the present place of posting. Learned counsel submits that, as per Clause 8 of the Transfer Policy, the Transfer Committee is required to consider issues relating to the medical treatment of family members. He, therefore, prays that the petitioner may be permitted to submit a representation under Clause 8 of the Transfer Policy and the Committee may be directed to consider the same in accordance with law and the applicable Transfer Policy.

Learned counsel for the respondents submits that, if the petitioner @les a representation before the Committee under Clause 8 of the Transfer Policy, the same shall be considered in accordance with the applicable policy and law within a period of 25 days.

In view of the submissions made by learned counsel for the petitioner as well as learned counsel for the State, the petitioner is permitted to @le a representation before the competent Committee within a period of 10 days from today. The Committee is directed to consider and decide the said representation within a period of 20 days from the date of its receipt.

5. Till the expiry of the aforesaid period of 30 days, the e;ect and operation of the impugned transfer order dated 06.08.2026, insofar as it relates to the petitioner, shall remain stayed.
6. Accordingly, the writ petition is disposed of with the aforesaid observations and directions. Sd/-
