1. Application in hand has been filed for grant of interim bail to the applicant-petitioner for a period of 90 days on medical grounds.

Learned counsel has pressed the prayer for grant of interim regular bail to the petitioner for his medical treatment, as he is suffering from paralysis of the bilateral lower limbs with bowel and bladder involvement along with chronic bed sores. His sensory reflexes are absent below the level of the nipples, and a Foley's catheter is present. Learned counsel for the petitioner, while pressing the aforesaid prayer for interim regular bail, has argued that the petitioner was earlier also granted the concession of interim regular bail vide order dated 21.01.2026 passed in CRM-M-72641-2025, and the said concession has not been misused till JATIN 2026.07.24 10:56 I attest to the accuracy and integrity of this document

Learned State counsel has submitted that the State is providing the requisite medical treatment to the petitioner while he is in custody and, thus, there is no requirement to grant him interim regular bail at this stage. 4. I have heard counsel for the parties and have gone through the available records of the case. 5. Keeping in view the entirety of the factual milieu of the case in hand; especially the medical condition of the petitioner, it not being denied that he requires regular medical treatment, the fact that he had earlier been granted the concession of interim regular bail vide order dated 21.01.2026 passed in CRM-M-72641-2025 which concession was not misused; this Court is inclined to grant interim regular bail to the petitioner for a period of three months from the date of his release, subject to such terms and conditions as may be imposed by the concerned Illaqa Magistrate/Chief Judicial Magistrate while releasing him on bail. However, in addition to conditions that may be imposed by the concerned CJM/Duty Magistrate, the petitioner shall remain bound by the following conditions:- (i) The petitioner shall not mis-use the liberty granted. (ii) The petitioner shall not tamper with any evidence, oral or documentary, during the trial. (iii) The petitioner shall not absent himself on any date before the trial. (iv) The petitioner shall not commit any offence while on bail. (v) The petitioner shall deposit his passport, if any, with the trial Court. (vi) The petitioner shall give his cell-phone number to the Investigating Officer/SHO of concerned Police Station and shall not change his cell-phone number without prior permission of the trial Court/Illaqa Magistrate.

-3- (vii) The petitioner shall not in any manner try to delay the trial. 6. In case of breach of any of the aforesaid conditions and those which may be imposed by concerned CJM/Duty Magistrate as directed hereinabove or upon showing any other sufficient cause, the State/complainant shall be at liberty to move for cancellation of bail of the petitioner. 7. Ordered accordingly. 8. Nothing said hereinabove shall be construed as an expression of opinion on the merits of the case. CRM-M-31657-2026

Learned counsel appearing for the petitioner, after arguing for some time, does not want to press the prayer for regular bail at this stage.
