APHC010287252026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI WRIT APPEAL NO: 685 of 2026 Bench Sr.No:- 80 [3579] Andhra Evangelical Lutheran Church (AEL Church) and others ...Appellants Vs. St. Peters Lutheran Church and others ...Respondents ********** Advocate for Appellants : Mr. R. K. Acharyulu Advocates for Respondents : Mr. Sriman - R1 to R5 Mrs. V. Dyumani (SC for Bank of India) - R7 & R8 CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE NINALA JAYASURYA DATE : 15th June, 2026. LISA GILL, CJ (Oral): This Writ Appeal has been filed challenging interlocutory order dated 22.05.2026 passed by learned Single Bench in I.A.No.1 of 2026 in W.P.No.14777 of 2026. 2. Learned counsel for appellants submits that operation of order dated 29.04.2026, passed by respondent No. 3, has been incorrectly suspended HCJ & NJSJ WA_685_2026 vide impugned order, with further direction for defreezing of accounts, numbers of which are detailed in the impugned order and that too, without affording an opportunity of hearing to present appellants. 2.1. It is submitted that appellants, arrayed as respondent Nos.4 and 5 in the writ petition are authorised persons of church affairs of St. Peters Lutheran Church, Dhanavaipeta, under control of Andhra Evangelical Lutheran Church, Guntur. Writ petitioners, it is stated, have suppressed material documents like orders passed in W.A.No.1033 of 2023, S.O.P.No.9 of 2022 and others. Writ petitioners have no authority to manage the funds in question. Irreparable loss shall be caused in case impugned order is not set aside. It is contended that every effort was made to mislead the Court. 3. Learned counsel for writ petitioners has denied the averments. 4. We have heard learned counsel for appellants. 5. In our considered opinion, at this stage, it is appropriate for appellants to file necessary application for vacation of interim order, as well as for listing of Writ Petition and place all the facts as have been urged before us, before learned Single Bench. In case such application(s) is/are filed, we are sanguine that they shall be taken up by learned writ Court and considered in accordance with law. HCJ & NJSJ WA_685_2026 6. With the said observation and liberty, this Writ Appeal is disposed of. There is no expression of opinion on merits of the matter. No costs. Pending miscellaneous application(s), if any, also stand(s) disposed of accordingly. LISA GILL, CJ. NINALA JAYASURYA, J. SSN
