In this application, the petitioner herein is aggrieved by the order dated 29.7.2026 passed by the learned Additional Sessions Judge, 3rd Court, Barrackpore. By the impugned
order, learned court below has rejected the petitioner’s prayer for adjournment and issued warrant of arrest against the present petitioner. Being aggrieved by the aforesaid order, learned counsel for the petitioner submits that there is no malice on the part of the petitioner to evade trial and the Trial court ought not to have issued warrant of arrest against the petitioner for not attending the court only on a single date. The court below while passing the impugned order, did not scrutinize the facts and has passed the order without applying judicial mind. However,
learned counsel for the petitioner on instruction submits that the petitioner wants to surrender before the court below and for which he seeks leave of this court. Having heard learned counsel for the petitioner, I find that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite
2 parties will have no cause to prejudice and as such, the service of copy of the application upon the opposite parties is dispensed with. Having heard learned counsel for the petitioner, the instant application being CRR 3260 of 2026 is hereby disposed of by giving liberty to the petitioner to surrender before the court below within a period of two weeks from this date and in the event of such surrender, the court below will dispose of his prayer in accordance with law without being influenced by any observations made herein. The impugned order dated 29.7.2026 in connection with SC case no. 565 of 2025 by which the warrant of arrest was issued against the present petitioner, is hereby stayed for a period of two weeks or till the petitioner surrenders before the court below, whichever is earlier. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities.
