The present petition has been filed seeking quashing of the impugned order dated 17.04.2026 (Annexure P-5) passed by learned Chief Judicial Magistrate-NRI, Jalandhar in FIR No. 161 dated 21.10.2022 under Sections 323, 295, 148, 149 and 506 of IPC (Section 115(2), 299, 191(3), 190, 351 of BNS), registered at Police Station Bhargo Camp, District PARUL 2026.07.24 11:09 I attest to the accuracy and authenticity of this document/order Jalandhar, whereby, the petitioner was proceeded as a proclaimed person on account of his failure to appear in the said proceedings. 2. Learned counsel for the petitioner submits that the petitioner has been declared as proclaimed person in FIR No. 161 dated 21.10.2022, wherein, he was earlier granted bail on 03.08.2023, however, subsequently the petitioner was again nominated in an another FIR bearing FIR No. 95 dated 24.11.2025, due to which he could not appear in the proceedings in FIR No. 161 dated 21.10.2022. Learned counsel for the petitioner further submits that the other FIR No. 95 was lodged by one Gurmeet Singh under Section 302 IPC, however, subsequently an affidavit was executed by the complainant clarifying that the name of the petitioner was wrongly given and he does not wish to pursue against the petitioner. It is further submitted that the petitioner is ready and willing to join the proceedings. 3. Learned State counsel has submitted that the petitioner was being represented through the counsel and the said fact has never been informed to the Court and there is no illegality or perversity in the order passed and the same is passed in accordance with law, however, could not deny the fact that the petitioner had been appearing on previous occasions before the Court regularly or had been seeking exemption in accordance with law.
