[ Mr. Abdul Masood Ms. Debanwita Pramanik …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant no.1 praying for direction upon the learned Civil Judge (Senior Division), 10th Court at Alipore, to dispose of the application under Order 6 Rule 17 of the Code of Civil Procedure along with Title Suit No. 15362 of 2011, expeditiously. The learned Advocate appearing for the petitioner submits that the application under Order 6 Rule 17 of the Code of Civil Procedure is otherwise ready for heading. From the order sheets appended to this application, this Court finds that 10th August, 2026 has been fixed for hearing of the application under Order 6 Rule 17 of the Code. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division), 10th Court at Alipore, to take up hearing of the application under Order 6 Rule 17 of the Code on the next 2 date fixed i.e. on 10th August, 2026 and shall make all endeavour to dispose of the same as expeditiously as possible but preferably within a period of eight weeks from the next date fixed without granting any unnecessary adjournments to either of the parties, if the same is otherwise ready for hearing. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities. (Hiranmay Bhattacharyya, J.)
