Mr. Manish Sen, Ms. Oisani Mukherjee …for the petitioner In this application, the petitioner has prayed for expeditious disposal of the proceeding being G.R. Case No.2913 of 2013 pending before learned Chief Judicial Magistrate, Burdwan Being aggrieved by the inordinate delay caused in disposal of the said proceeding, it is submitted that there has been no progress in the case, particularly, for latches on the part of the prosecution. Petitioner has retired from service as Associate Professor of a College in March, 2026 but no pensionery benefits have been paid to him because of pendency of the criminal proceeding. Therefore, being an accused, he prayed for expeditious disposal of the said proceeding. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having considered the fact that in this case charge sheet was submitted by the Investigating Agency on 13.10.2013 and since then the Court below has not conducted charge hearing for last 13 years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. 2 In view of above, the instant application being CRR 3100 of 2026 is hereby disposed of with a direction upon the Court below to conclude the charge hearing within a period of 3 months from the next date of hearing.
