JUSTICE P SREE SUDHA ORAL ORDER Learned counsel for the petitioner is present and stated that he served notice to the learned counsel for the respondent on 22.07.2026 and filed a memo to that effect on 28.07.2026. But neither the respondent nor his learned counsel turned up before the Court. 2. Heard the arguments of learned counsel for the petitioner. 3. This civil petition is filed by the petitioner/wife for transfer of M.C.No.6346/2024 filed by the husband for divorce, from the IV Additional Principal Judge, Family Court, Bengalore, to the Court of Principal Judge, Family Court, Mysuru. - 3 - HC-KAR CNR: KAHC010749352024 NC: 2026:KHC:40303 CP No. 534 of 2024 4. The petitioner/wife is residing in Mysore with her parents and her minor son, aged 6 years. The marriage between the parties was solemnized on 17.02.2016 and a baby boy was born on 24.09.2018. The petitioner stated that she has filed a petition for maintenance, wherein the respondent was directed to pay maintenance of Rs.10,000/- to her and Rs.12,000/- to the minor son. But the respondent has preferred a Revision Petition before the Hon'ble High Court of Karnataka at Bengaluru. The respondent has also filed G & WC No.64/2024 before the Principal Judge, Family Court at Mysuru. Therefore, the petitioner requested for transfer of M.C.No.6346/2024 from Bengalore to Mysuru, which is at a distance of 146 kilometers. The petitioner is not working and earning. It is further stated that the respondent already filed G & WC No.64/2024 before the Principal Judge, Family Court at Mysore, and it is also convenient for him to travel to Mysore for attending the divorce case. - 4 - HC-KAR CNR: KAHC010749352024 NC: 2026:KHC:40303 CP No. 534 of 2024 5. Considering the arguments of learned counsel for the petitioner and in the absence of respondent's arguments, this Court finds that it is just and reasonable to transfer M.C.No.6346/2024, filed by the respondent/husband for divorce before the Court of IV Additional Principal Judge, Family Court, Bengalore, to the Court of Principal Judge, Family Court, Mysuru, as G & WC No.64/2024 filed by respondent is pending before the same Court.
