Since the controversy involved in all these writ petitions is common and the reliefs sought are substantially identical, they were heard together 10 and are being decided by this common order. For the sake of convenience, the pleadings and documents of WPS No.1097 of 2026 are being referred. 2. In these writ petitions, the petitioners have called in question the respective orders passed by the respondent authorities, whereby their request for grant of permission/study leave to pursue the two-year Veterinary Polytechnic Diploma/Diploma in Animal Husbandry course was declined. The petitioners have also sought a consequential direction to the respondents to permit them to pursue and complete the aforesaid course, with all consequential benefits. 3. Learned counsel for the petitioners submits that the petitioners had sought permission/study leave for pursuing the two-year Veterinary Polytechnic Diploma/Diploma in Animal Husbandry course. Their prayer was declined by the respondents vide the impugned orders. It is submitted that, subsequently, similarly situated candidates have been permitted to pursue the aforesaid course, despite the fact that, at the relevant point of time, no specific policy/rule had been framed governing such permission. It is further submitted that the petitioners have already obtained provisional admission in the University and have been pursuing their studies, and denial of permission to them would result in serious prejudice, particularly when similarly situated candidates have been granted such permission. 4. Learned State counsel, on instructions, submits that the State has now formulated a policy dated 30.07.2026 governing the matter. It is further 11 submitted that after passing of the impugned orders, some candidates have been permitted to pursue the course, particularly having regard to the fact that they had already obtained admission. Learned State counsel submits that the case of the petitioners would also be considered in accordance with the extant policy dated 30.07.2026. 5. Learned counsel appearing for respondent No.4 submits that two semesters of the course has already been completed and as the petitioners have already obtained provisional admission, therefore, in the interest of the petitioners and their academic career, they can only be permitted to pursue the course, subject to the applicable rules/policy and the decision of the competent authority. 6. Having considered the submissions made by learned counsel for the parties and having regard to the subsequent development, as also the submission of learned State counsel that subsequent to passing of the impugned orders, similarly situated candidates have been permitted to pursue the course, this Court is of the view that the petitioners' cases deserve consideration in the light of the subsequent policy and the changed circumstances. 7. It is not in dispute that the petitioners have already obtained provisional admission and that two semesters have elapsed. At this stage, denial of an opportunity to pursue the course, particularly when similarly situated candidates have subsequently been permitted to do so, may cause serious prejudice to the petitioners and render the academic opportunity already availed by them nugatory. 12 8. In view of the aforesaid facts and circumstances, the impugned orders are hereby set aside, insofar as they relate to the petitioners. The respondents are directed to consider the case of respective petitioner and permit them to continue/pursue the two-year Veterinary Polytechnic Diploma/Diploma in Animal Husbandry course in which they have already obtained provisional admission. Since the petitioners have already undergone two semesters, the respondents/competent authority shall take all consequential steps, including permitting the petitioners to continue their studies and appear in the examinations, subject to the applicable academic regulations. 9. The respondents shall, however, consider the petitioners' cases at par with similarly situated candidates who have been permitted to pursue the course after passing of the impugned orders. The entire exercise shall be completed expeditiously, preferably within two weeks from the date of receipt of a copy of this order. 10. It is made clear that the order passed in the present batch of writ petitions is being rendered in the peculiar facts and circumstances of the cases and on the basis of the stand taken by the respondents, including the policy formulated on 30.07.2026 and the specific circumstances noticed hereinabove. The directions contained herein shall, therefore, not be treated as a precedent or relied upon as laying down any general principle of law in respect of grant of study leave/permission to pursue the course, and the question of entitlement in other cases is left open to be considered on their own facts and in accordance with the applicable rules/policy. 13 11. Having regard to the aforesaid submissions and the subsequent development, it is evident that the State Government has, during the pendency of these petitions, formulated a policy dated 30.07.2026 governing the grant of permission to the concerned candidates to pursue the course. Accordingly, henceforth, the cases of similarly situated candidates shall be considered and dealt with by the respondents in accordance with the said policy. 12.
