19-08-2026 Item No.19 Subrata Bhattacharyya AR(C) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction Appellate Side WPA No.8259 of 2026 Samir Kumar Dandapat -vs- The State of West Bengal & Ors. Mr. Anjan Bhattacharya Ms. Anita Shaw Ms. Seema Thakur …for the petitioner Mr. Indradeep Pal Ms. Sougata Pal Das …for the State 1. The petitioner’s prayer seeking grant of two additional increments for acquiring Ph.D degree has been forwarded by the school to the District Inspector of Schools (SE), Paschim Medinipur in November 2025, and the same is alleged to be kept pending. 2. According to the petitioner, he would be entitled to the increments in terms of the directive of the School Education Department, Secondary Branch in Memo No.37-SAE/ES(S)/5P-37/2010 dated January 5, 2012 (Annexure P4, p.30). 3. As it appears that the petitioner’s prayer seeking two additional increments is pending consideration before the DI of Schools, accordingly, no useful purpose would be served by keeping the writ petition pending. 4. Hence, the writ petition stands disposed of by directing the DI of Schools to consider the prayer of the petitioner strictly in the light of the said directive dated January 5, 2012 at the earliest but positively within twelve weeks from the date of communication of this order. 5. If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by the said respondent without any further delay. 6. Learned advocate for the petitioner is directed to forward a copy of the subject representation seeking consideration along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court. 7. All parties are to act on the server copy of this order duly downloaded from the official website of this Court. 8. Certified server copy of this order, if applied for, shall be made available to the parties. [Amrita Sinha, J] 2 3
