Challenging the order passed by the 6th respondent dated 26.12.2025, the petitioner has filed this Public Interest Litigation. 2/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.3892 of 2026 2. The petitioner originally gave a representation seeking to cancel the assignment originally granted to various persons and to restore the Government land as vaari. Pursuant to the direction of this Court in W.P(MD)No.29711 of 2024, the representation of the petitioner was considered and an order came to be passed rejecting his representation. Challenging the same, this writ petition is filed. 3. The main allegation raised by the petitioner before the authorities was that Survey No.190/1, 9, 10, 11 to an extent of 1.16.5 ares in Mathur Village, Kulathur Taluk and Pudukkottai District was classified as vaari and the said land has been assigned to various persons by sub-dividing the land. According to him, the assignment has been obtained by fabrication of records and the assignees are not residing in the particular village and the entire revenue records have been changed. Therefore, he sought to restore the original classification. 4. Considering the petitioner's submissions and on field inspection and also the revenue records, the authorities rejected his claim holding that originally the land was Government poramboke land which was assigned to the respondents 9 to 12 and it has been further held that it was never classified as vaari at any point of time and it is only classified as Government poramboke land and medu pallam and pursuant to the order dated 20.12.2002, an extent of 3/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.3892 of 2026 1.16.5 hectares of land which was originally classified as Government land, was assigned to respondents 9 to 12 on various conditions. One of the prime conditions is that the assigned land should not be sold within a period of ten years and in the event of any sale, the same can be permitted with the permission of the Revenue Divisional Officer. As per the conditions, it appears that the assignees have approached the authorities namely, the Revenue Divisional Officer for sale of properties after ten years and obtained necessary permission and sold the properties to third parties. Now further transactions are also taken place. Thus, we do not find any merit or substance in the contention of the petitioner that the subject land was originally classified as vaari namely, water course. 5. Perusal of the impugned order indicates that the land was originally classified as Government poramboke land medu pallam only. Those lands were sub-divided and assigned to the respondents 9 to 12 as indicated above. Only after obtaining permission from the Revenue Divisional Officer, the properties have been dealt with and third party rights have been created. It is relevant to note that assignment of the year 2002 has not been challenged at any point of time. Similarly, the permission granted by the Revenue Divisional Officer to sell the assigned properties also has not been challenged. Therefore, merely giving representation in the year 2025 and get it rejected through the order 4/7 https://www.mhc.tn.gov.in/judis W.P(MD)No.3892 of 2026 impugned and challenging the same before this Court by filing this writ petition, in our view, is only to create a cause of action. Hence, we do not find any merits in this writ petition. 6. Accordingly, this Writ Petition is dismissed. No costs.
