No.73/2019 (Vemagal Police) now which is pending on the file of the Principal Civil Judge (Junior.Dn) and JMFC, Kolar. ii) Quash the F.I.R. in Crime No.73/2019 (Vemagal Police) now which is pending on the file of the Principal Civil Judge (Junior.Dn) and JMFC, Kolar for the offences punishable under sections 420, 468, 471 r/w 149 IPC. iii) Pass any order/s as deems fit in the facts and circumstances of the case in the interest of justice." 2. In Crl.P.No.10605/2023, the petitioner is before this Court seeking the following prayers: - 5 - HC-KAR CNR: KAHC010404502019 NC: 2026:KHC:39271 CRL.P No. 5429 of 2019 C/W CRL.P No. 10605 of 2023 CRL.P No. 12241 of 2025 "WHEREFORE, the petitioner/accused No.40 in the above criminal petition humbly prays that, this Hon'ble Court may be pleased to quash the F.I.R. and entire proceedings in Crime No.73/2019 registered by the Vemagal Police for the alleged offences punishable under Section 420, 471, 468, 149 of Indian Penal Code on the file of the Hon'ble Principal Civil Judge and JMFC at Kolar in the ends of justice." 3. In Crl.P.No.12241/2025, the petitioners are before this Court seeking the following prayers: "WHEREFORE, The Petitioners above named most humbly prays that this Hon'ble Court may be pleased to quash the entire proceedings against the petitioners in Crime no. 73/2019 punishable under Section 420, 471, 149 OF I.P.C. registered by Vemagal police on the file of Prl., civil Judge (Junior judge (Junior division) and j.m.f.c. At Kolar for the offences in the interest of justice." 4. In Crl.P.No.5429/2019, heard Sri.Sunil Kumar S, learned counsel appearing for the petitioner. In Crl.P.No.10605/2023, heard Sri. Ramesha H.N, learned counsel appearing for the petitioner, Sri.M.Narayana Reddy, learned counsel appearing for respondent No.2. In Crl.P.No.12241/2025, heard Sri.H.R.Narayan Swamy, learned counsel appearing for the petitioner, Sri.B.N.Jagadeesha, learned SPP-I appearing for respondent-State, and have perused the material on record. - 6 - HC-KAR CNR: KAHC010404502019 NC: 2026:KHC:39271 CRL.P No. 5429 of 2019 C/W CRL.P No. 10605 of 2023 CRL.P No. 12241 of 2025 5. The learned SPP-I on instructions would submit that the final report will be filed before the concerned court within one week from today, subject to the PSO. Learned counsel Sri.Sunil Kumar S, submits that if that be so, he be reserved liberty to challenge the charge sheet so filed before the concerned Court. 6. The learned counsel appearing for the petitioners submits that there should be no coercive steps in the meantime. 7. Learned SPP-I would submit that the matter is pending before the concerned authority for sanction. There can be no question of coercive steps being taken at this juncture.
