Sah …for the Petitioner In this application, the petitioner herein has prayed for a direction upon the court below for expeditious disposal of the interim maintenance application filed by the petitioner under the proviso to Section 144(1) of the BNSS. Being aggrieved by the inordinate delay caused in disposal of the said prayer, learned counsel for the petitioner submits that the petitioner/wife filed such application in M. case no. 58 of 2025 which is now pending before the learned Judicial Magistrate, 1st Court, Barasat on 24th January, 2025 and since then for about one year seven months have been passed but the court below has kept the said application pending till date and therefore, she prayed for necessary direction for expeditious disposal of the said prayer as well as the proceeding. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice and as such, the service of copy of application upon the opposite parties is hereby dispensed with. 2 Having considered the submissions made on behalf of the petitioner, the instant application being CRR 3177 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the interim maintenance application filed by the petitioner and to make his best effort to dispose of the same preferably within a period of three months from the next date of hearing and thereafter, he will make his best endeavour to conclude the entire proceeding at the earliest. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
