Rakib CRM (M) 847 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baharampur Police Station case no. 1780 of 2025 dated 12.08.2025 under Sections 64(2)(f)/351(3) of the Bharatiya Nyaya Sanhita, 2023 and Under Section 6 of the POCSO Act. And In the matter of : Madhab Mukherjee @ Madhab. ……Petitioner. Mr. Mani Sankar Chattopadhyay .....for the Petitioner. Mr. L. Vishal Kumar .....for the State Learned advocate appearing for the petitioner submits that petitioner is in custody for 367 days, charge-sheet has already been submitted and petitioner is unnecessarily harassed. Learned advocate appearing for the State opposes the prayer for bail, draws the attention of the Court to the statement of the victim under Section 183 of the BNSS as well as the medical documents. I have taken into account the overall circumstances; however, none of the parties could apprise this Court whether the evidence of the victim till date is over. In view of the aforesaid, learned trial Court is directed that after the evidence of the victim is over the petitioner be released on bail on such terms and conditions as the learned trial Court deems fit and proper. 2 Additionally, it is stated that if the evidence of the victim has not commenced, learned trial Court would commence and try to conclude the evidence of the victim within a period of three months. With the aforesaid observations CRM (M) 847 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
