HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CRM(M) No. 483/2025
Shamim Akhter and Ors. .....Appellant(s)/Petitioner(s)
Through :- None.
v/s UT of J&K and Ors. .....Respondent(s)
Through :- Mr. Sumeet Bhatia, GA.
CORAM: HON’BLE MR. JUSTICE YASH PAUL BOURNEY, JUDGE
ORDER 25.09.2026
1.
Learned counsel for the respondents submits that pursuant to the FIR, the investigation stands completed but due to the interim directions, the Incharge Police Station concerned is unable to lay the charge-sheet before the competent Court of law. He has accordingly sought permission of this Court to lay the charge-sheet.
2. Since the investigation stands concluded and the investigating agency in its wisdom has found substance in the allegations during the course of investigation. Therefore filing of the charge sheet would be the natural consequence, however, if the petitioners still have any grievance, they may project the same before the trial Court by way of an application for discharge or by arguing statement at the stage of charge. In the aforesaid view of the matter, this petition does not survive and is, accordingly, dismissed.
3. Dismissed along with connected CMs.
