The instant writ petition has been filed, inter alia, praying for a direction upon the respondent authorities to take note of the illegal construction carried out by the respondent nos. 10, 11 and 12 at Dag No. 245, J.L. No. 29 (Sabek Dag No. 148) under Tarakeswar Municipality. 3. Having heard the learned advocates appearing for the respective parties and noting that a complaint has been made on 11th July, 2026, I am of the view that the municipal authorities must take a decision on the petitioner’s complaint by giving an opportunity of hearing to all the concerned and dispose of the same by passing a reasoned order in accordance with law. 2 WPA 18262 of 2026 4. It is expected that a decision in this regard shall be taken by the municipal authorities within a period of four weeks from the date of communication of this order. 5. Let it also be recorded that the State has already proceeded in the matter and a notice has been issued by the Block Land & Land Reforms Officer, Tarakeswar, Hooghly, on 7th August, 2026 under Section 57 of the West Bengal Land Reforms Act, 1955, and a field enquiry has been directed to be conducted. 6. This order shall not stand in the way of the appropriate authority for concluding the proceedings as indicated above in accordance with law. 7. With the above observations and directions, the writ petition is disposed of. Urgent photostat certified copy of this order, if applied for be given to the parties upon compliance with the requisite formalities. (Raja Basu Chowdhury, J.)
