CWP-22122-2026 -2- No objection was raised by the petitioners against order dated 23.12.2025 at any stage.
4. Though Mr. Verma has attempted to rely upon Annexures P-43 which as per him was the reply filed by the petitioners to the application for impleadment filed by respondent No.5 before Financial Commissioner, but the same would also reveal that the petitioners are aggrieved of alleged forcible dispossession rather than impleadment of respondent No.5 in ROR before the Financial Commissioner.
5. At this stage, Mr. Verma confines his argument and seeks liberty to raise objection w.r.t. forcible dispossession of the petitioners by respondent No.5 in partition proceedings.
6. Having heard counsel for the petitioner and after carefully perusing the records of the case, the present writ petition is disposed off with liberty to the petitioners to raise all objections available including that of their forcible dispossession by respondent No.5 who has been impleaded as party after institution of partition application.
7. Ordered accordingly. July 21, 2026 (Pankaj Jain) Dpr
