Memo of evidence be taken on record. 2. Learned advocate for the petitioner submits that the petitioner has been falsely implicated in the instant case, nothing has been recovered from his possession. He has been implicated in this case, on the basis of the statement of two accused persons recorded while in custody. The charge-sheet has already been submitted. He prays for anticipatory bail. 3. Learned advocate for the State submits that the charge-sheet has been submitted in this case. 2 However, the material in the case diary shows that there are criminal antecedents of the present petitioner, so far as the case under Section NDPS Act is concerned. She submits that the petitioner is a habitual offender. Learned advocate for the State opposes the prayer for anticipatory bail. 4. Considering, the aforesaid facts and circumstances of the case, I am not in a position to return a finding that the petitioner has been able to overcome the restrictions under Sections 37 of the NDPS, Act. 5. Hence, the prayer for anticipatory bail of the petitioner is Rejected. 6. CRM(A) of 2387 of 2026 is dismissed. (Md.Shabbar Rashidi. J)
