1. Heard learned counsel for the parties and perused the material available on record.

These bail applications have been preferred by the accused- petitioners Harishankar S/o Narayan & Rajesh Kumar S/o Harishankar, under Section 482 of B.N.S.S., apprehending their arrest in connection with the FIR No.140/2025 dated 08.12.2025 registered at Police Station Peeplu, District Tonk for the offences punishable under Section 303(2) of BNS, Section 4 and 21 of the MMDR Act, 1957.

Learned counsel for the accused-petitioners submitted that the accused-petitioner have falsely been implicated in the present case. Learned counsel further submitted that the fine as imposed upon them has been deposited under the MMDR Act and further the cases as pending against them are not of serious nature.
Learned counsel submitted that they are ready to co-operate with the investigation as and when called by the Investigating Officer. In view thereof, learned counsel prayed that the accused- petitioners being innocent persons, who have falsely been implicated in the present case, be extended the benefit of bail.
4. Learned Public Prosecutor opposed the bail applications.
5. Considering overall peculiar facts and circumstance of the case, this Court is inclined to exercise its powers U/s. 482 of BNSS and deems it just and proper to grant anticipatory bail to the accused-petitioners.

Accordingly, these bail applications filed by the accused- petitioners under Section 482 BNSS are allowed and it is directed that in the event of arrest of accused-petitioners Harishankar S/o Narayan & Rajesh Kumar S/o Harishankar, in connection with FIR No.140/2025 dated 08.12.2025 registered at Police Station Peeplu, District Tonk, they shall be enlarged on bail provided each of them furnish a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of concerned I.O./S.H.O. on the following conditions:- (i) they shall make themselves available for interrogation by Investigating Officer as and when required;
[2026:RJ-JP:11918] (3 of 3) [CRLMB-1294/2026] (ii) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any Police Officer; (iii) they shall not leave India without prior permission of the court.
