2 Bilaspur (C.G.), for the offence under Section 20(b) of NDPS Act. Earlier application was rejected on merits by this Court vide order dated 23.07.2025 passed in MCRC No.6627/2026.

Brief facts of the case are that on 12.04.2026, Bharat Lal Rathore, Sub-Inspector, Police Station Sarkanda, received secret information that co-accused Sudama Kenwat @ Rani Yadav was illegally possessing and selling Ganja at Patliputra, Rajkishore Nagar, Sarkanda, Bilaspur (C.G.). After completing the requisite statutory formalities, the police party, along with other staff members and independent witnesses, proceeded to the spot and conducted a raid, where two women were found sitting on two scooters outside a house. They disclosed their identities as the present Applicant and Sudama Kenwat @ Rani Yadav. During the search, 5 kilograms of Ganja, one Scooty, one car, two wristwatches, one mobile phone and cash of Rs.5,98,030/- were allegedly seized from the possession of the present Applicant while 1 kilogram of Ganja, one Activa scooter and one mobile phone were seized from the possession of Sudama Kenwat @ Rani Yadav. Based on the aforesaid allegations, the police registered the offence as mentioned above against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant
3 is innocent and has been falsely implicated in the present case. He further submits that the Applicant is a woman and is suffering from serious medical ailments, having allegedly sustained severe injuries during her arrest, including fracture of the hip bone and is also suffering from a gynecological ailment, for which she is undergoing treatment at CIMS Hospital, Bilaspur but has not obtained adequate relief and requires specialized treatment at a higher medical centre. It is further submitted that the Applicant has been in custody for more than four months, the trial is still at the stage of framing of charges and no prosecution witness has yet been examined, despite the liberty granted while rejecting her earlier bail application to conclude the trial expeditiously, thereby constituting a substantial change in circumstances and indicating that the trial is likely to take considerable time. He further submits that the alleged recovery of 5 kilograms of Ganja is intermediate in quantity, the Applicant is in custody since 12.04.2026 and the trial is likely to take considerable time for its conclusion, therefore, she may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that the Applicant has two previous criminal antecedents under the NDPS Act, pertaining to the
4 years 2024 and 2026.

Considering the submissions advanced by learned Counsel for the parties, the material available in the case diary, the nature of allegations, the alleged recovery of 5 kilograms of Ganja from the Applicant and the fact that the Applicant has two previous criminal antecedents under the NDPS Act pertaining to the years 2024 and 2026, without further commenting anything on the merits of the case, this Court is not inclined to grant bail to the Applicant.
6. Accordingly, the bail application of the Applicant – Manki Kenwat @ Vinita Joshi involved in Crime No.482/2026 registered at Police Station – Sarkanda, Bilaspur (C.G.), for the offence under Section 20(b) of NDPS Act is hereby rejected.
