1. Memo of evidence filed by the State is taken on record. 2. Learned advocate for the petitioner submits that the present petitioner is the husband of the alleged victim. It has been alleged that the petitioner used to inflict torture upon the victim for demand of further dowry. The marriage took place in the year 2019. The statement recorded under Section 180 of the BNSS shows that the petitioner used to demand further dowry from the victim which drove her to commit suicide. 3. Learned advocate for the State opposes the prayer for anticipatory bail and submits that the victim’s parents had already expired. The victim had no other
2 place to stay. The investigation of the case is still in progress. 4. In the aforesaid facts and circumstances of the case and considering the materials available in the case diary as well as the post-mortem report, I am inclined to release the petitioner on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall meet the investigating officer once a fortnight till the conclusion of the trial and the petitioner shall appear on every date before the jurisdictional court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. 5. The Prayer for anticipatory bail of the petitioner is allowed. 6. CRM (A) 2433 of 2026 is disposed of. 3 10 .
