Present Writ Appeal is filed with the following prayer: “It is, therefore, prayed that this Hon’ble Court may kindly be pleased to set aside the order dated 14.05.2026 passed by Hon’ble Single Bench in W.P.(C) No.2383/2023 and the respondents be directed not to take any coercive steps against the appellant’s fair price shop, in the interest of justice.” 2. Brief facts as mentioned in the appeal are that the appellant society is a registered cooperative society under the C.G. Co-operative Societies Act, 1960, Registration No. D.R.B.S.P. 11/1996. It has around seven employees and presently operates five fair price shops in District Gourella-Pendra-Marwahi. The society has invested substantial amounts in buildings, godowns, staff and other infrastructure and sustains its operations mainly through government commission. Since 2001, Respondents No. 6 and 7 have allotted fair price shops to the appellant society subject to certain conditions. The appellant claims to have operated the shops sincerely and without any adverse allegation since 2001. By advertisements dated 12.05.2023, 21.07.2022 and 17.02.2023, Wa 714 of 2026 3 three of its five shops were proposed to be allotted to other societies/committees. It is contention of the appellant that the proposed allotment was made without issuing any show-cause notice or providing an opportunity of hearing to the appellant. Aggrieved thereby, the appellant filed W.P.(C) No. 2383/2023 before the Hon’ble High Court, which was dismissed vide order dated 14.05.2026. Hence this appeal by the writ petitioner. 3. After arguing for some time, learned counsel for the appellant prays for withdrawal of this appeal with liberty to approach before the learned Single Judge for redressal of its grievance in appropriate proceedings. 4.
