1. The present writ petition has been filed, inter alia, praying for the direction upon the municipal authorities to consider the petitioner’s complaint dated 14th July, 2026. According to the petitioner, the private respondent is running a business from the ground floor of premises No. 143/27, Picnic Garden Road, P.S. –Tiljala, Kolkata 700039 without any certificate of enlistment issued by the municipal authorities. 2. The private respondent is represented and has placed before this Court a certificate of enlistment issued by the municipal authorities for carrying on a trade of Goldsmith from the ground floor of the aforesaid locale. of the aforesaid document as placed before this Court be taken on record. 3. According to Mr. Sarkar, learned advocate appearing for the private respondent since the private respondent has previously lodged a complaint against the petitioner on 10th July, 2026, as a counterblast thereto, the instant writ petition has been filed. Let the copy of the complaint as lodged by the private respondent with the Officer-in-Charge, Tiljala P.S. placed before this Court be taken on record. 4. The municipal authorities have also filed a report. Mr. Ghosh, learned advocate appearing for the municipality would submit that immediately upon receipt of the complaint, the municipal authorities had inspected the locale on 3rd August, 2026 and found there is an existing four storied building. The building is quite old structure and had been built long ago. The same is found in occupied condition. It is also noted that there are five shops in the said premises, one of which is a jewellery shop and there is no visible sign of ongoing construction. The petitioner also owns a chicken meat shop. 5.
Having heard the learned advocates appearing for the respective parties and noting from the materials on record that the petitioner also is carrying on business from a shop room and

there appears to be no irregularity in the private respondent carrying on business and also noting that certificate of enlistment has been issued in favour of the private respondent by the municipal authorities, I am of the view there is no scope for this Court to pass any mandatory order in the writ petition. 6. Accordingly, the writ petition is dismissed without any order as to costs. (Raja Basu Chowdhury, J.)
