Accused no.1 in Crime No.78/2026 registered Kempegowda Nagar Police Station, Bengaluru City, for the offences punishable under Sections 109, 351(2), 352 read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.78/2026 was registered by Kempegowda Nagar Police Station, Bengaluru City, for the aforesaid offences against the petitioner and another based on the first information dated 26.06.2026 received from Jeeva, who is the injured victim in the present case. Apprehending arrest in teh said case, petitioner had filed Crl. Misc. No.6609/2026 before the jurisdictional Sessions Court, which was rejected on 10.07.2026. Perusal of the material on record would go to show that petitioner and the injured victim are neighbours. The incident in question had taken place after the parties had fought against each other on the issue of parking their motor bike. Petitioner after quarrelling with the victim, allegedly had assaulted him with stones on his head. Accused no.2 had assaulted the victim with a dragger on his left leg. The victim has suffered two injuries, out of which, one is grievous injury. The grievous injury which is on the left leg of the victim is corresponding to the assault made by accused no.2. Petitioner has no other criminal antecedents. He has undertaken to co-operate with the police for the purpose of investigation. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.78/2026 registered Kempegowda Nagar Police Station, Bengaluru City, for the offences punishable under Sections 109, 351(2), 352 - 4 - HC-KAR CNR: KAHC010510092026 NC: 2026:KHC:44825 CRL.P No. 11104 of 2026 read with 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
