Accused nos.1 & 2 in Crime No.198/2026 registered by Ramamurthy Nagar Police Station, Bengaluru City, for the offences punishable under Sections 103(1) read with 3(5) of BNS, 2023, are before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.198/2026 was registered by Ramamurthy Nagar Police Station, Bengaluru City, for the aforesaid offences against the petitioners herein based on the first information dated 22.03.2026 received from Lakshmi - mother of deceased. In the said case, petitioners were arrested on 22.03.2026 and remanded to judicial custody. After completing investigation, charge sheet is filed against three persons. Petitioner's bail application filed before the jurisdictional Sessions Court in Crl. - 3 - HC-KAR CNR: KAHC010450882026 NC: 2026:KHC:42012 CRL.P No. 9683 of 2026 Misc. No.25534/2026 was rejected on 22.06.2026. Therefore, he is before this Court. 4. The material on record would go to show that accused nos.1 to 3 are friends and they used to regularly consume alcohol together. Deceased Kiran who was alcoholic used to often request the accused persons to provide him alcohol and in the event they did not provide liquor to him, he was abusing and assaulting them. 5. On 21.03.2026 at about 7.00 p.m., when accused nos.1 to 3 were consuming alcohol in the auto rickshaw belonging to accused no.1, deceased Kiran came there and allegedly asked them to provide him liquor. Accused persons allegedly refused to provide liquor to deceased Kiran and went away. In the early hours of 22.03.2026, deceased Kiran allegedly once again met the accused persons who were gambling along with others and requested them to provide him alcohol. The accused persons allegedly refused to provide alcohol to Kiran and went away. Subsequently, accused nos.1 to 3 decided to murder Kiran, who was often troubling them. And in furtherance of this, accused - 4 - HC-KAR CNR: KAHC010450882026 NC: 2026:KHC:42012 CRL.P No. 9683 of 2026 no.1 has assaulted the deceased Kiran with a metal rod on his head and other parts of the body and accused no.2 supported accused no.1 to commit the murder by keeping a watch. Accused no.3 allegedly was sitting inside the auto rickshaw of accused no.1. 6. The entire case of the prosecution is based on circumstantial evidence. It is not in dispute that petitioners do not have criminal antecedents. Accused no.3 has been granted regular bail by this Court in Crl.P.No.7446/2026 disposed of on 10.07.2026. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.198/2026 registered by Ramamurthy Nagar Police Station, Bengaluru City, for the offences punishable under Sections 103(1) read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties for - 5 - HC-KAR CNR: KAHC010450882026 NC: 2026:KHC:42012 CRL.P No. 9683 of 2026 the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their his appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
