Present petition has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of interim bail to the petitioner in case FIR No.116 dated 20.08.2025 under Sections 109, 115(2), 3(5) of BNS (Sections 27/54/59 of Arms Act and Section 238(B) of BNS added later on), registered at Police Station Gidderbaha, District Sri Muktsar Sahib.

Learned counsel for the petitioner, facing reliance placed upon the averments made, inter alia, in paragraph 6 of the petition, has submitted that, paragraph 6 of the petition reads thus:
“That a fresh medical certificate dated 06.06.2026 issued by Prime Care Hospital, Bathinda certifies that Rajveer Kaur, aged about 36 years, is suffering from uterus- related bleeding and severe anaemia. The certificate further records that despite treatment, her Haemoglobin (Hb) levels are not improving and therefore her planned surgery has been extended up JATIN 2026.07.24 10:22 I attest to the accuracy and integrity of this document
CRM-M-33801-2026 (O&M) -2- to 21.06.2026. A copy of the medical certificate issued by Prime Care Hospital dated 06.06.2026 has been annexed herewith as Annexure P-3. He further submits that the petitioner is the primary caregiver of his wife and is urgently required to be with her for her medical treatment, including surgery. 3. Pursuant to the notice of motion issued on 12.06.2026, learned State counsel has filed a reply. The relevant portion of the State's reply reads as under: That in compliance with the order dated 12.06.2026, the SHO, Police Station Gidderbaha, deputed S/Ct. Charanjeet Kumar to verify the medical documents relied upon by the petitioner. Accordingly, on 15.06.2026, the said official visited Dr. Romana's Prime Care Hospital, Bathinda and moved an application before Dr. S.S. Romana for verification of the medical certificate dated 06.06.2026 annexed by the petitioner as Annexure P-3. Upon verification, Dr. S.S. Romana confirmed that the certificate dated 06.06.2026 had been issued by him and endorsed the same by affixing his official stamp and signatures. A copy of the endorsement is annexed herewith as Annexure R-3. 18. That during verification, Dr. S.S. Romana further a written medical opinion 15.06.2026, wherein he stated that Mrs. Rajveer dated Kaur, aged 36 years, is suffering from per-vaginal bleeding and anaemia and has been symptomatic treatment for control of bleeding. The doctor further advised expert gynaecological/surgical consultation for detailed evaluation and treatment. She was also advised to undergo ultrasonography (USG) of the uterus to rule out any fibroid or other abnormality. The doctor specifically opined that any further surgical intervention, if required, shall be decided only after evaluation by the concerned gynaecology specialist. Thus, as per the latest medical opinion, no immediate surgery has been advised and the necessity of any surgical procedure is yet to be determined upon further specialist evaluation.

Keeping in view the entirety of the factual milieu of the case in hand, especially the factum that the petitioner is the primary caregiver of his wife, the petitioner is not involved in any other case, and the primary allegation against the petitioner is under Section 109 of BNS, this Court is inclined to grant interim regular bail to the petitioner for a period of 30 days, subject to such terms and conditions as may be deemed appropriate by the concerned Illaqa Magistrate/CJM while releasing him on bail. However, in addition to conditions that may be imposed by the concerned CJM/Duty Magistrate, the petitioner shall remain bound by the following conditions:- (i) The petitioner shall not mis-use the liberty granted. (ii) The petitioner shall not tamper with any evidence, oral or documentary, during the trial. (iii) The petitioner shall not absent himself on any date before the trial. (iv) The petitioner shall not commit any offence while on bail. (v) The petitioner shall deposit his passport, if any, with the trial Court. (vi) The petitioner shall give his cell-phone number to the Investigating Officer/SHO of concerned Police Station and shall not change his cell-phone number without prior permission of the trial Court/Illaqa Magistrate. (vii) The petitioner shall not in any manner try to delay the trial. 5. In case of breach of any of the aforesaid conditions and those which may be imposed by concerned CJM/Duty Magistrate as directed hereinabove or upon showing any other sufficient cause, the State/complainant shall be at liberty to move for cancellation of bail of the petitioner. 6. The petitioner shall cause his appearance before the concerned Illaqa Magistrate/CJM upon the expiry of 30 days from the date of his release.
