Learned advocate appearing for the petitioner submits that unnecessarily petitioner has been detained in custody and although the whole case has been portrayed for having recovery of 14798 bottles but so far as the petitioner is concerned from his godown there has been 6798 bottles of phensedyl. It has been also pointed out by the learned advocate for the petitioner that the prosecution has relied upon 36 witnesses. As such, there is no possibility of trial being taken to its logical conclusion. So the petitioner be released on bail. Learned advocate appearing for the State opposes the prayer for bail and submits that charges have already

been framed and all efforts be exerted to complete the relevant witnesses. Considering the submissions advanced by the State, I direct that the learned trial court to exhaust the process of law for completing at least independent seizure list witnesses relating to the petitioner by 31st December, 2026. At this stage, CRM (NDPS) 823 of 2026 is dismissed. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
