Also heard Mr. Bhaskar Sarma, learned Additional Public Prosecutor for the State of Assam and Ms. T Porashor, the learned Amicus Curiae appearing for the respondent No.2. Page No.# 2/2 2. This is an application under Section 483 of the BNSS, 2023 in respect of Sessions (Special) Case No. 15/2026 pending in the Court of the learned Special Judge (POCSO), Kamrup (Metro) at Guwahati. 3. On 15.11.2025, the victim girl had lodged an FIR before the police stating that when she was a 16 year old, she was married by the present petitioner. After marriage, she was beaten up by other family members of the petitioner. 4. I have considered the submissions made by the learned counsel of both sides. 5. May be the victim was a minor at the time of her marriage with the petitioner, she filed the FIR only because she was subjected to physical harassment by the petitioner. 6. This Court is of the opinion that the petitioner no longer deserves to be detained in custody. 7. Therefore, it is hereby directed that the petitioner Rahul Neog shall be released on bail of ₹25,000/- (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the learned Special Judge (POCSO), Kamrup (Metro) at Guwahati. 8. With the aforesaid direction, this Bail Application stands disposed of accordingly. JUDGE Comparing Assistant
