By the said communication, the petitioner's request to release the gold jewels pledged by the daughter of the petitioner, namely, Rani, wife of Kumar, came to be rejected. 2.The petitioner's daughter availed gold loan from the first respondent Bank and offered gold jewels as a security towards repayment of the said loan. The whereabouts of the petitioner's daughter is unknown and a missing certificate has also been obtained and thereafter, the petitioner, who is her mother, discharged the gold loan and thereafter, submitted an application to release the gold jewels deposited by her daughter. However, the said request has not been acceded to by the respondent Bank citing that the second respondent, who is the husband of the petitioner's daughter, has objected to the request made by the petitioner. 2/4 https://www.mhc.tn.gov.in/judis W.P.(MD)No.9610 of 2026 3.The learned counsel for the second respondent, on instructions, submitted that the second respondent has no objection for releasing the gold jewels in favour of the petitioner. The said submission is taken on record. 4.In the light of the submission made by the learned Counsel for the parties, the impugned order passed by the first respondent, dated 21.02.2026 is set aside and a direction was issued to the first respondent to release the gold jewels pledged by the petitioner’s daughter to the petitioner forthwith subject to the petitioner and the third respondent executing indemnity bond. 5.The writ petition stands disposed of accordingly. There shall be no order as to costs.
