Accused in Crime No.270/2026 registered by the Avalahally Police Station, Bengaluru City, for the offences punishable under Sections 75(1)(i) and 76 of the BNS, 2023, is before this Court in this petition filed under Section 483 of the BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.270/2026 was registered by Avalahally Police Station, Bengaluru City, for the aforesaid offences against a cab driver based on the first information dated 10.06.2026 received from alleged victim, who was aged about 27 years. During the course of investigation of the said case, the petitioner was arrested on 11.06.2026 and remanded to judicial custody. His bail application filed before the - 3 - HC-KAR CNR: KAHC010482932026 NC: 2026:KHC:43807 CRL.P No. 10442 of 2026 jurisdictional Sessions Court in Crl.Misc.No.1243/2026 was rejected on 27.06.2026. Therefore, he is before this Court. 4. In the first information, it is alleged that on 09.04.2026 the victim lady had visited her sister's house at A.Narayanapur and had booked a Ola Cab. At about 12.37 pm., the cab bearing registration No.KA-05 AQ 7124 picked her up from her sister's house. The driver was found taking her in a different route and when she questioned, he allegedly informed her that due to heavy traffic, he was taking a different route. Subsequently, he stopped the cab in an insolated place and suddenly moved to the backseat and inappropriately touched her private parts. It is under these circumstances, FIR was registered against the cab driver and during the course of investigation, the petitioner was arrested. 5. Investigation of the case is now completed and charge sheet is already filed. Considering the nature of allegations found against the petitioner, who has no other criminal antecedents and the punishment provided for the alleged offences, I am of the opinion that the prayer made by the - 4 - HC-KAR CNR: KAHC010482932026 NC: 2026:KHC:43807 CRL.P No. 10442 of 2026 petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. 6. Accordingly, the following: ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.270/2026 registered by the Avalahally Police Station, Bengaluru City, for the offences punishable under Sections 75(1)(i) and 76 of the BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 5 - HC-KAR CNR: KAHC010482932026 NC: 2026:KHC:43807 CRL.P No. 10442 of 2026 d) The petitioner shall not involve in similar offences in future.
