1. The petitioner has filed the instant petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (439 of the Cr.P.C.) with a prayer to grant the concession of regular bail to him in case FIR No. 94 dated 09.04.2026, registered at Police Station Industrial Sector 7, Manesar, District Gurugram under Sections 109(1), 115(2), 121(1), 132, 190, 191(2), 221, 223(a), 324(4), 324(5), 326(f) and 61(2) of BNS (Sections 307, 323, 332, 353, 149, 147, 186, 188, 427, 435 and 120-B of IPC) and Section 3 of PDPP Act. 2. The FIR in the present case was registered on the basis of the complaint filed by Ramveer Singh. As per the complainant, 200/250 workers had gathered in front of Richa Global Exports Private Limited, Sector 7, IMT, Manesar, on 09.04.2026, and started the protest without any notice. Thereafter, some of persons in the group had become violent, pelted stones, damaged HEMLATA 2026.07.24 11:41 I attest to the accuracy and integrity of this document

The police officials were also present at the spot, and after the situation escalated, the police force was called and every effort was made to control the mob. With these broad allegations, the FIR in the present case was registered. 3. Learned Senior counsel submits that the petitioner is a poor factory worker and the protest was made by the laborers for hike of the wages. The petitioner was not present for the entire duration of protest and even he had arrived at the spot with the sole intention of participating in a peaceful assembly. Even, none of the protesters was carrying any weapon nor engaged in any kind of violence. The entire procession of the laborers was quite peaceful and there was no damage to any property of the factory. The petitioner was arrested on 09.04.2026 and is in custody since then. 4. On the other hand, learned State counsel has vehemently opposed the prayer made by the learned counsel for the petitioner on the ground that there are serious allegations against the petitioner and the petitioner is not entitled for the concession of regular bail.
5. I have heard learned counsel for the parties and perused the record. 6. From a perusal of the FIR, it is evident that the petitioner was part of the mob, which had assembled in front of the company M/s Richa Global Export Private Limited on 09.04.2026, which had assembled with a demand of raising their wages. Even, it is apparent that the protest was more or less peaceful protest and the workers had gathered only to raise their voice for their rights. It can never be said that the petitioners or other labourers had any intention of creating some law and order problem or to cause damage to public property.
