The present writ petition has been filed seeking following relief(s):- 10.1 That, this Hon'ble Court may kindly be pleased to call for the entire record from the respondent authorities. 10.2 That, this Hon'ble Court may kindly be pleased to direct respondent authorities to select petitioner in the
2 post of Dialysis Technician, Level-06 (group-B), in accor- dance with law. 10.3 That, this Hon'ble Court may kindly be pleased to quash/set aside impugned order dated 22/08/2019 (An- nexure-P/1). 10.4 That, this Hon'ble Court may kindly be pleased to quash/set aside impugned letter dated 22/08/2019 (An- nexure-P/2). 10.5 That, this Hon'ble Court may kindly be pleased to direct the respondents to pay the cost of this petition along with advocate fee to petitioner, as decided by this Hon'ble Court. 10.6 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deem fit and appropriate, in favor of petitioner, in the interest of justice. 2. Learned counsel for the petitioner submits that the petitioner had se- cured the first rank in the merit list for the post of Dialysis Technician, Level-06 (Group-B) and fulfilled all the prescribed eligibility criteria. However, despite being fully eligible, the petitioner was not included in the provisional selection list.
It is further submitted that the petitioner possesses the requisite two-year Diploma in Dialysis Technician from a recognized institution and was duly registered with the Madhya Pradesh Para Medical Council and subsequently obtained reciprocal registration with the Chhattisgarh Paramedical Council. Therefore, the action of the respondent authorities in overlooking the petitioner's can- didature is arbitrary and illegal. 3. Learned State counsel submits that the petitioner was rightly declared ineligible, as registration with the Chhattisgarh State Paramedical Council was a mandatory eligibility condition under the advertisement and the Rules of 2015. Since the petitioner obtained registration with the Chhattisgarh Paramedical Council only on 04.07.2019, i.e., much after the last date for submission of the application form i.e. 30.06.2018, he was not eligible for consideration. It is further submitted that the petitioner's objection was duly considered and rejected by the Selection Committee, and thereafter Respondent No. 3 was selected
3 and appointed against the post. Thus, the impugned action has been taken strictly in accordance with the applicable Rules and the writ peti- tion, being devoid of merits, is liable to be dismissed
4. I have learned counsel for the parties and perused the records. 5. A careful perusal of Annexure R/1 would show that one of the pre- scribed qualifications for the post was that the candidate must be regis- tered with the State Paramedical Council. It is further specifically stipu- lated in the advertisement that all certificates required of the applicant must be valid and subsisting on the date of submission of the applica- tion. The last date for submission of the application form was 30.06.2018, whereas the petitioner obtained registration with the Chhattisgarh State Paramedical Council only on 04.07.2019. Thus, ad- mittedly, the petitioner did not possess the requisite registration certifi- cate as on the last date of submission of the application form. Accord- ingly, the petitioner was rightly held ineligible and his candidature was rejected.
I find no merit in the present petition. The writ petition is, ac- cordingly, dismissed. Sd/-
