20.08.2026 IN THE HIGH COURT AT CALCUTTA Item No.813 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (NDPS) 1719 of 2026 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with New Barrackpore Police Station Case No. 376 of 2025 dated 22.12.2025 under Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Saddam Mohammad ... Petitioner. Mr. Kamalesh Chandra Saha, Mr. Arka Mukherjee, Mr. Anurag Bose ... For the Petitioner. Mr. Brajesh Jha, APP, Mr. Neel Chakraborty ... For the State. Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 78.97 kgs. of Ganja and petitioner is in custody for 239 days. It has been submitted that charge-sheet has already been submitted before the jurisdictional court. As such, petitioner may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account that the charge-sheet has been submitted before the jurisdictional court. Learned Trial Court would expedite the process of consideration of charges. Having regard to the fact that presently the petitioner has failed to overcome the rigours of Section 37 of 2 the NDPS Act, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 1719 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
