……Petitioner.
Mr. Bikash Ranjan Bhattacharya, Sr. Adv.
Mr. Samim Ahammed
Mr. Asif Ikbal Baidya
Ms. Reshma Khatun
Mr. Md. Nazirul Haque

….for the Victim/Defacto Complainant/OP No. 2.
Mr. Tirtheswar Das
……for the State.
Learned Senior Advocate appearing for the petitioner submits that the petitioner has been falsely implicated and foisted with the present criminal case which has no legs to stand. The complaint itself is absurd and motivated.
Learned advocate for the defacto complainant opposes the prayer for bail.
2
Learned advocate for the State has produced the case diary referred to the statement under Section 183 of the BNSS of the victim. There are some deficiencies definitely in a case of this nature but having considered the statement of the victim before the learned Judicial Magistrate, I am not inclined to extend the benefit of anticipatory bail.
Accordingly, the prayer for anticipatory bail in CRM (A) 2162 of 2026 is refused.
Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
