The challenge in the instant writ petition is to the proceedings of the 4th respondent dated 18.05.2026, whereunder the petitioner’s Chairman/President was required to appear before him on 22.05.2026. It is contended that before the said notice, the 4th respondent issued another notice dated 11.05.2026, to the President/Chairman of the Petitioner society, requiring him to submit the relevant record in connection with an enquiry initiated against him. To the said notice, the Chairman of the petitioner Society has submitted a reply stating that the Secretary of the petitioner Society, son of the Chairman of the Petitioner Society, who was dealing with all the business affairs of the Society, and maintaining the records of the petitioner society, had died. Therefore sought time to secure all the records and submit the same before the authority. 3. The petitioner contends that, despite seeking time to submit the documents as required under the proceedings dated 11.05.2026, the 4th respondent did not consider the said request for adjournment, passed the impugned orders on 22.05.2026. 4. It is contended that the Secretary of the petitioner's society, who was managing the accounts of the society, expired in the month of March, 2026. 3 Consequently, the documents required by the 4th respondent could not be traced, as the documents were in the custody of the deceased. 5. Learned counsel for the petitioner submits that the petitioner's society is taking all reasonable steps to submit the documents as required by the 4th respondent. However, some more time is required to locate and trace and the said documents. 6. Having regard to the contentions advanced, this Court deems it appropriate to dispose of the writ petition granting further time of two (02) weeks to the President of the petitioner’s society to submit the documents sought by the 4th respondent vide proceedings dated 11.05.2026, from the date of receipt of a copy of this order. Till submission of those documents, the respondents are directed not to take any coercive measures against the President of the petitioner’s society. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
