Accused Nos.1 to 5 in Crime No.110/2026 registered by Bajpe Police Station, Mangaluru City, for the offences - 3 - HC-KAR CNR: KAHC010475752026 NC: 2026:KHC:40687 CRL.P No. 10247 of 2026 punishable under Sections 115(2), 118, 351(2), 352 and 190 of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.110/2026 was registered by Bajpe Police Station, Mangaluru City, for the aforesaid offences against the petitioners herein based on the first information dated 25.06.2026, received from Abdul Nasir, who is one of the injured victims in the present case. Apprehending arrest in the case, petitioners had filed Crl.Misc.No.578/2026 before the jurisdictional Sessions Court, which was rejected on 09.07.2026. Therefore, they are before this Court. 4. Victims in the present case are the father-in-law and wife of accused No.1. It appears that there is a dispute between accused No.1 and his wife, who is one of the alleged victims in the present case. It is in this background quarrel had taken place between the parties and subsequently petitioners allegedly had assaulted the first informant and his daughter. Undisputedly, injured victims in the present case have suffered - 4 - HC-KAR CNR: KAHC010475752026 NC: 2026:KHC:40687 CRL.P No. 10247 of 2026 only simple injuries. Petitioners are persons without any criminal antecedents and they have undertaken to cooperate with the police for the purpose of investigation. Learned counsel for respondent No.2 has expressed an apprehension that the petitioners may indulge in committing similar offences in future. Under the circumstances, I am of the opinion that prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.110/2026 registered by Bajpe Police Station, Mangaluru City, for the offences punishable under Sections 115(2), 118, 351(2), 352 and 190 of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- - 5 - HC-KAR CNR: KAHC010475752026 NC: 2026:KHC:40687 CRL.P No. 10247 of 2026 each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. 4. The petitioners shall not involve in similar offences in future. 5. In the event, petitioners indulge in committing similar offences in future, respondents are at liberty to file necessary application seeking cancellation of bail. 6. In view of the disposal of the main petition, pending interlocutory application, if any, does not survive for consideration. Hence, the same is dismissed.
