Learned advocate appearing for the petitioners submits that the petitioners are unnecessarily detained behind the custody for 1 year 5 months. Although charges have been framed, but till date, none of the witnesses have been examined. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that 103 kgs. of ganja were recovered in the present case and the seizure list contains signature of the present petitioners. Having regard to the quantum of seizure in the present case, I am of the opinion that rigors of Section 37 of the NDPS Act is prima facie being attracted. At this stage, the prayer for bail of the petitioners is rejected. Petitioners will renew their prayer for bail 2 after the evidence of seizure list witnesses are completed. Learned trial court would expedite the process of the examination of the seizure list witnesses, preferably within a period of four months from date. Accordingly, CRM(NDPS)991 of 2026 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
