2. Mr. Chittrarth Kandpal, learned Brief Holder for the State.
3. Present bail application has been moved by the applicant, who is in judicial custody in connection with FIR No.126 of 2026, under Section 8/20 of NDPS Act, P.S. Rudrapur, District Udham Singh Nagar.
4. Heard learned counsel for the parties.

Learned counsel for the applicant submits that applicant has no concern with the alleged incident and police party falsely implicated him in the present crime; there was no independent witness of the alleged recovery. He further submits that 5.890 kg of the contraband named Ganja, was alleged to be recovered from the possession of the applicant and that is below the commercial quantity.
6. Learned State counsel has opposed the bail application.
7. Having heard learned counsel for the parties and considering the facts and circumstances of this case, the applicant is entitled to be released on bail.
8. Accordingly, bail application is allowed. Let the applicant-Rajeev Kumar Sahani be released on bail on executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of court concerned.
