JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the registration of a crime in crime No.65/2025 registered for the offences punishable under Sections 3(5), 316(2), 318(4), 318(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita (BNS), 2023. 2. Heard Sri. Manjunath K.V., learned counsel appearing for the petitioner, Sri. K. Nageshwarappa, learned High Court Government Pleader appearing for respondent No.1, - 3 - HC-KAR CNR: KAHC010474292025 NC: 2026:KHC:39710 CRL.P No. 10232 of 2025 Sri. Akshay Raj B.R., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record such settlement along with the joint affidavit. Terms of settlement reads as follows: "JOINT AFFIDAVIT We, Kiran Kumar A, S/o A.Venugopal, aged about 40 years, R/at No.691, MIG A sector, Yelahanka, Bangalore North, Bangalore-560 064, and S.Ramesh S/o Subbarayappa, aged about 55 years, R/at Barjankunte Village, Tondebavi Hobli, Gowribidanur Town and Taluk, Chikkaballapura District-Now at Bangalore 561 206, do hereby solemnly affirm and state as follows: 1. We state that we are the petitioner and Respondent No.2 in the above case, and we know the facts and circumstances of the case. Hence, we are swearing to this affidavit. 2. The Petitioner is the accused No.2. 3. The Respondent No. 2 is the Complainant in Crime No.65/2025 for offences punishable under section 3(5), 316(2), 318(4), 318(2), 351(2), and 352 of BNS against the Accused No. 1. 4. We state that all are Friends and business partners. 5. That the complaint and FIR was filed due to some misunderstanding in our business transactions. The Petitioner regrets the - 4 - HC-KAR CNR: KAHC010474292025 NC: 2026:KHC:39710 CRL.P No. 10232 of 2025 same. On the intervention of well-wishers, elders and friends, we have amicably settled the business account and all transactions amongst ourselves and do not intend to precipitate the matter further. As such, we have amicably decided to close the matter. 6. All allegations made in the complaints by the second Respondent are withdrawn unconditionally. 7. We state that there is no undue influence or pressure on us to settle the matter. 8. We state that in the light of the above, this Hon'ble Court may be pleased to allow the above Petition and quash the Crime No. 65/2025 for offences punishable under section 3(5), 316(2), 318(4), 318(2), 351(2), and 352 of BNS. What is stated above is true to the best of our knowledge, belief and information." 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioner in the subject petition. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition stands disposed. - 5 - HC-KAR CNR: KAHC010474292025 NC: 2026:KHC:39710 CRL.P No. 10232 of 2025 (ii) Investigation in crime No.65/2025 pending before the II Additional Senior Civil Judge and JMFC Court, Chikkaballapura, against the petitioner stands quashed.
